APC files cross-appeal urging supreme court to expunge documents tendered by Atiku at tribunal

The All Progressives Congress (APC) on Tuesday filed a cross-appeal at the supreme court, urging the apex court to expunge some documents and evidence tendered by the Peoples Democratic Party (PDP) at the election petition tribunal from the bar.

The ruling party is urging the court to erase evidence provided by witnesses 40, 59 and 60 at the tribunal.

The party is also urging the court to set aside the decision of the presidential election petitions tribunal to admit such evidence and documents.

According to the ruling party’s counsel, Lateef Fagbemi, the tribunal erred by admitting the documents, describing the act as a miscarriage of justice and violation of the law.

Fagbemi argued, “The learned justices of the court of appeal erred in law when they failed to consider or properly consider the cross-appellant’s objection to the admissibility of the documents tendered by the petitioners/cross-respondents’ counsel from the bar.”

“Inadmissible documents/evidence cannot be admitted based on the overall interest of justice but of law.”

The opposition Peoples Democratic Party (PDP) and its flag bearer in the last general election, Atiku Abubakar, had earlier on Tuesday filed an appeal at the apex challenging the decision of the election petition tribunal to dismiss its petition against Buhari and the APC.
