Evans wins round 1 of fundamental right enforcement suit, case to continue

Ebun Francis ||  A Lagos High Court Presided over by Justice Abdulaziz Anka on Wednesday ruled that fundamental right enforcement suit filed by Chukwudumeme Onwuamadike, the billionaire kidnapper arrested in Lagos earlier this year should proceed.

The Judge in his ruling dismissed the preliminary objection raised on Tuesday by counsel to Nigeria Police, Emmanuel Eze in the N300m suit filed by Evans through his counsel Olukoya Ogungbeje.

Justice Anka agreed with counsel to Evans that the first and second respondents were properly served contrary to the arguments of the defense counsel.

The Judge also ruled that leave was not required for the matter to be heard during vacation as Order 4 Rule 5 of the Fundamental Rights Enforcement Procedure Rules of 2009, enjoins the court to pursue speed and justice on issues of fundamental human rights.

Evans, through his lawyer, had filed a N300m lawsuit against the police, challenging his continued detention since June 10 without arraignment.

The notorious kidnapper currently being detained in an unknown location in Abuja by the Nigeria Police force is asking the court to award him N300m as exemplary damages for his alleged illegal detention and the alleged harm caused by his media trial.
