Chidi Samuel| The election of Senator Rochas Okorocha as the lawmaker representing Imo West district in the national assembly was on Thursday upheld by the Court of Appeal sitting in Owerri, the Imo State capital.
In the judgment read by Justice R. Ada, the panel chairman, the court held that the appeals filed by Senator Osita Izunaso of the All Progressives Grand Alliance (APGA) and Jones Onyereri of the Peoples Democratic Party (PDP) lacked merit.
Izunaso and Onyereri had challenged the election of the former governor who contested the February 23 election on the platform of the All Progressives Congress (APC).
The appellate court while affirming the decision of the tribunal which ruled that Okorocha was duly elected, noted that the petitioners were unable to prove their allegations of over-voting, mutilation of electoral results, violence, and the hijacking of electoral officers.
The court also held that the allegation by the returning officer that he declared the election result under duress could not be proved.
