The suit seeking to for the seat of Senate president, Bukola Saraki, Speaker of the house of representatives Yakubu Dogara and 52 other lawmakers for defecting from one political party to another was on Friday struck out by a federal high court in Abuja.
Justice Okon Abang, the presiding judge, while delivering judgement in the suit filed by Legal Defence and Assistance Project (LEDAP), ruled that the body lacked the legal right to institute it.
According to Abang, LEDAP’s status as a registered corporate body under the Company and Allied Matters Act was not sufficient to confer the right to institute the action on behalf of the public.
Abang ruled,“Plaintiff has not placed anything before the court to show that any of the constituents who voted the lawmakers into office are even aware of the suit.”
The judge also ruled that LEDAP’s decision not to join the Peoples Democratic Party (PDP) and the All Progressives Congress (APC) which sponsored the elections of the defector legislators, was fatal to the suit.
