Kano Emirates: Appointment of new Emirs illegal- Court rules

A Kano state high court sitting in Ungogo and presided over by Justice Nasiru Saminu on Wednesday declared the appointment and the installation of four new emirs by Abdullahi Ganduje, governor of Kano state, as illegal.

In a ruling on a prayer by the counsel to the plaintiffs, A. B Mahmoud (SAN), Justice Saminu held that the earlier order it issued had not been vacated, hence the appointments of the emirs could not stand.

The court then adjourned the case till June 20, 2019 for continuation.

It will be recalled that the Minority and Minority Whip of the Kano state House of Assembly, Hon Rabi’u Sule Gwarzo and Hon Babangida Yusuf Sulaiman, have dragged Kano state governor, Dr Abdullahi Umar Ganduje, Kano state government, Kano state House of Assembly, Kano state Printing Press and Clerk of Kano State House of Assembly to court challenging the creation of four additional emirates in the state.

At the resumed hearing of the case on Wednesday, Counsel to the Plaintiffs, A.B Mahmoud told the court that the action of the defendants was a complete disregard to rule of law and that the order must be respected by the defendants.

According toMahmoud, since an order was issued by the court, the defendants must comply with order by maintaining status quo as requested by the court.

However, counsel to the Defendants and the Attorney General of the state, Ibrahim Mukhtar argued that the court could not rule on anything that had been concluded.
Mukhtar said, “the law that paved way for the creation of the four additional emirates has been passed by the state assembly, the governor has given his assent to the law, it was gazette, the emirates have been created and emirs appointed.”

According to him, the order in question was not served on some of the defendants until Sunday while others were served on Wednesday.
